Wage & Hour Rights and Responsibilities
Wage Payment: Employee rights consist of:- Pay for all incomes made (INFO # 3) at the rate consented to by the company and staff member.
– Pay of at least base pay (INFO # 1), the relevant Colorado or local base pay, and all made overtime earnings without impermissible reductions from their incomes;.
– Pay of all made wages without impermissible deductions (INFO # 16).
Labor Statutes, Rules, & Published Guidance
Statutes & Rules: DLSS enforces many of Colorado’s wage and hour and other types of labor statutes and labor rules, including the Colorado Wage Act, the Colorado Overtime and Minimum Pay Standards (” COMPS Order”), and the Equal Pay for Equal Work Act. Please visit the Division’s Labor Statutes and Labor Rules webpages for current and prior variations of essential Colorado labor statutes and guidelines.
Published Guidance: The Division’s main kinds of public guidance are:- INFOs (Interpretive Notices and Formal Opinions) – the Division’s formally approved notices, opinions, and descriptions on different labor law subjects; and.
– KNOWLEDGEs (Knowledge for Workers on Labor Law is Empowering & Drives Good Employment) one-page summaries for workers on their labor rights.
Written Demands, Complaints, & Investigations
Demands & Complaints for Wages: If an employer owes you earnings, you can send your company a composed need for payment of salaries by mail, e-mail, text, or other electronic means. A written demand may be sent out to the company at the very same time a Labor Standards Complaint Form for unsettled wages is submitted with the Division. The Labor Standards Complaint Form can be found on our Demands, Complaints, Responses, and Settlements website.
Employer Responses in Investigations: Once a total Labor Standards Complaint Form is received and reviewed, a letter explaining the nature of the grievance and the quantities alleged to be owed is sent to the company. Investigations Launched by the Division (” Direct Investigations”): The Division might carry out employer-wide direct investigations of potential offenses of Colorado wage and hour law. If you would like to submit a private claim for overdue salaries, you need to complete a Labor Standards Complaint Form on our Demands, Complaints, Responses, and Settlements web page.
